Terms of Use & Conditions of Sale

These Terms of Use and Conditions of Sale (“Terms”) govern your access to and use of www.detailshack.co.za (the “Site”) and any purchase of products on the Site. The Site is operated by Detail Shack (“Detail Shack”, “we”, “us”). By using the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1) Who we are & how to contact us

2) Changes to these Terms

We may update these Terms from time to time by posting a new version on the Site and updating the effective date above. Material changes will be highlighted on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

3) Eligibility & account

• You must be 18 or older and have legal capacity to enter into a binding agreement.
• Account holders are responsible for keeping login details confidential and for all activity under the account.
• We may suspend or terminate accounts for breach of these Terms, abuse, fraud, or security concerns.

4) Use of the Site

You agree not to:

• Interfere with or disrupt the Site, bypass security, or use automated scraping without consent.
• Upload unlawful, misleading, infringing, or harmful content.
• Use the Site for any purpose prohibited by South African law.

5) Product information, safety & availability

• We strive for accurate product information (including directions and compatibility) but minor variations in packaging or labeling may occur.
• Always follow label directions and usage guidance on the product page. Keep chemicals away from children and pets; avoid eye/skin contact; do not ingest; use in well-ventilated areas.
• All products are subject to availability. We may limit quantities, discontinue items, or substitute equivalent packaging without prior notice.

6) Pricing, VAT & promotions

• Prices are displayed in South African Rand (ZAR) and include VAT unless stated otherwise.
• We may correct pricing or typographical errors; if an error affects your order, we will contact you to confirm or cancel with a full refund.
• Promotions and discount codes are time-limited, non-transferable, and subject to stated conditions. Only one promotion may apply per order unless otherwise specified.

7) Orders & payment

• Your order is an offer to purchase; order confirmation acknowledges receipt. We accept your offer when we dispatch the goods and send a dispatch confirmation.
• Payment methods include card and Instant EFT via PayFast, SnapScan, and standard EFT. We do not store full card or banking details.
• We may refuse or cancel orders (e.g., suspected fraud, product unavailability, pricing error). If payment was taken, you will be refunded.

8) Shipping, risk & delivery

• Shipping options, fees, and delivery estimates are shown at checkout. See our Shipping & Returns page for current details.
• Risk of loss passes to you upon delivery to the address provided or collection by you/your agent.
• Please inspect parcels on delivery and report visible damage within 7 days with photos so we can address it quickly.

9) Returns, refunds & warranty

• Unused items in original packaging may be returned within 14 days of delivery; follow the process on our Shipping & Returns page.
• If an item arrives damaged or defective, contact support@detailshack.co.za within 7 days with photos; we will repair, replace, or refund as appropriate.
• Nothing in these Terms limits your rights under the Consumer Protection Act, 68 of 2008 (CPA).

10) Reviews, user content & community

• If you submit reviews, photos, or comments, you grant Detail Shack a non-exclusive, royalty-free licence to use, reproduce, and display that content on the Site and our social channels, subject to our Privacy Policy.
• We may moderate, edit, or remove content that is unlawful, misleading, infringing, offensive, or unrelated to our products.
• Only post content you own or are authorised to share, and do not include personal information of others without consent.

11) Intellectual property

The Site and its content (including text, graphics, logos, product names and images) are owned by or licensed to Detail Shack and protected by applicable intellectual property laws. You may not copy, distribute, modify, reverse engineer, or create derivative works from the Site or its content except as permitted by law or with our prior written consent.

12) Third-party services & links

The Site may link to third-party sites or integrate third-party services (e.g., payment gateways, couriers, analytics, social media). Their terms and privacy policies apply to your use of those services. We are not responsible for third-party content or practices.

13) Privacy, cookies & tracking

We process personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA). See our Privacy Policy and Cookie Policy for details on personal information, cookies, analytics (Google Analytics 4), and social media pixels (consent-based). Manage consent at any time in Cookie Settings.

14) Warranties & disclaimers

• We provide the Site “as is” and “as available”. While we aim for accuracy and uptime, we do not warrant uninterrupted or error-free operation.
• To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, regarding the Site and products, except as expressly stated on the product page or required by the CPA.

15) Limitation of liability

To the extent permitted by law, Detail Shack will not be liable for indirect, incidental, special, or consequential losses, loss of profits, or loss of data arising out of or related to the Site or products. Our total liability for any claim will not exceed the amount paid for the product giving rise to the claim, except where the CPA provides otherwise.

16) Indemnity

You agree to indemnify and hold Detail Shack harmless from claims or demands (including reasonable legal fees) made by any third party due to your breach of these Terms or misuse of the Site, except to the extent caused by our negligence or wilful misconduct.

17) Governing law, ECTA & jurisdiction

These Terms are governed by the laws of the Republic of South Africa. The Electronic Communications and Transactions Act, 25 of 2002 (ECTA) applies to electronic transactions and communications on this Site. You consent to the non-exclusive jurisdiction of South African courts (or the forum required by applicable consumer law). Nothing in these Terms limits rights you may have under the Consumer Protection Act.

18) Termination

We may suspend or terminate access to the Site at any time where reasonably necessary (e.g., security, legal compliance, breach of these Terms). On termination, provisions that by their nature should survive (e.g., intellectual property, disclaimers, liability limits) will remain in effect.

19) General

• If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
• Failure to enforce any right is not a waiver of that right.
• These Terms constitute the entire agreement between you and Detail Shack regarding the Site and sales, and supersede prior understandings.
